Important information for Opportunity Plus account holders

On October 10, 2006, ING Life Insurance and Annuity Company (the “Company”) entered into a settlement agreement with the New York Attorney General’s Office (NYAG) regarding the endorsement by the NYSUT Member Benefits Trust of the Company’s Opportunity Plus 403(b) variable annuity contract. Under terms of the NYAG agreement, the Company agreed to distribute $30 million to Opportunity Plus 403(b)(1) account holders who participated in this Member Benefits’ endorsed product at any point between January 1, 2001 and June 30, 2006 (the “settlement period.”) If you were a participating account holder, beneficiary, or alternate payee in the Member Benefits’ endorsed Opportunity Plus 403(b)(1) Tax Deferred Annuity program during the settlement period, you note a positive adjustment applied to your account on January 26, 2007.
